Abstract: The Banking Act 2009, covering England, Scotland, Northern Ireland and Wales, strengthens the UK's statutory framework for financial stability and depositor protection. The Act puts in place a permanent special resolution regime (SRR), providing the Financial Services Authority (FSA), Bank of England and Her Majesty's Treasury with tools to protect financial stability by effectively resolving banks and building societies that are failing, while protecting depositors, taxpayers and the wider economy. This Code of Practice, issued in accordance with sections 5 and 6 of the Act, supports the legal framework of the SRR, and provides guidance as to how and in what circumstances the Authorities will use the special resolution tools.--Introduction.
