One called as a juror in a criminal case who states that he has formed an opinion as to the guilt or innocence of the accused which it would take strong evidence to remove, but that he could lay aside his previous impressions and be governed by the evidence given at the trial and the law as charged by the court, is incompetent.It is held in this case that the testimony of the accomplice charging the defendant with murder is untrustworthy and uncorroborated in any material fact, and therefore insufficient to support a conviction.On a trial for murder, it is error to admit evidence that the defendant had stated, at the close of the preliminary examination, that his son had confessed to him the commission of the murder, as the accused was not on trial charged with knowingly concealing a murder committed by another.
