Abstract: During the 2002 session of the General Assembly, the Revised Uniform Arbitration Act (RUAA) was introduced (SB 307). Its introduction was part of a nationwide effort to update state arbitration laws. To date, eight states have passed some version of the RUAA. SB 307 remained in committee and has not been acted upon in either the 2003 or 2004 sessions. Nonetheless, the ADR Joint Committee has noted that the RUAA, if enacted in Virginia, would change the law of arbitration in many ways in the Commonwealth. This article compares the RUAA and existing Virginia law and identifies some of the problems the RUAA might create, if adopted. A condensed version of this article is being published in two installments in the spring and fall 2004 issues of Virginia ADR, the newsletter of the Virginia ADR Joint Committee. By comparing provisions unique to the RUAA with the existing Virginia arbitration statute ("VUAA"), this article will attempt to access the potential impact upon the practice of arbitration in Virginia should the RUAA be passed without amendment.
